Terms of service
Effective 26 June 2026
These terms are the agreement between you and HappierBiz for use of our software at happierbiz.com.au and related apps (the “Service”). By creating an account or using the Service, you agree to them. Please read them alongside our Privacy policy.
Who can use the Service
You must be at least 18 and able to enter a binding contract, and if you sign up on behalf of a business you confirm you’re authorised to do so. You’re responsible for your account, for keeping your login secure, and for what the people you invite do under it.
Trial and subscription
- Free trial. New accounts get a time-limited trial with no card required. You can stop any time before it ends and you won’t be charged.
- Paid plans. After the trial, continued use needs a paid subscription. The current plans, prices and any GST treatment are shown at sign-up and on your billing page — these prevail over anything stated elsewhere.
- Billing. Subscriptions renew automatically each period until cancelled. Paid add-ons (such as extra staff seats) are billed in line with their stated rate, prorated where applicable.
- Changes & cancellation. You can change plan or cancel at any time from your billing page. Cancelling stops future charges; we don’t generally refund the current period unless the law requires it.
- Price changes. We may change prices on reasonable notice; changes take effect from your next renewal.
Payments to you (via Stripe)
If you collect payments from your own customers through the Service, those payments are processed by Stripe into your connected Stripe account. You are the merchant for those transactions — you’re responsible for your pricing, refunds, taxes and customer relationships, and your use of Stripe is also subject to Stripe’s terms. HappierBiz doesn’t hold your customers’ funds and never sees full card numbers.
Your data and content
- You own it. The business and customer data you put into the Service remains yours. You grant us only the permission needed to host and process it so we can run the Service for you.
- Your responsibility. You’re responsible for having the right to use the data you enter, for handling your customers’ and staff’s personal information lawfully (including your own privacy obligations), and for the accuracy of what you record.
- Export. You can export your data while your account is active. After cancellation it’s available during a short grace period (around 90 days) and then permanently deleted, as described in the Privacy policy.
Acceptable use
You agree not to:
- Break the law. Use the Service for anything unlawful, fraudulent, or harmful, or to send spam or unsolicited marketing.
- Abuse the system. Attempt to access another business’s data, probe or breach security, reverse-engineer the Service, or disrupt its operation.
- Overload or resell. Resell or provide the Service to third parties except as intended, or place unreasonable load on it (e.g. automated scraping).
- Upload harmful content. Upload malware, or content you don’t have the rights to, or that is unlawful or infringing.
We may suspend access where necessary to protect the Service, other customers, or to comply with the law.
Third-party connections
The Service can connect to external tools you choose (for example your accounting software). Those tools are governed by their own terms and privacy practices, and we’re not responsible for them. You can disconnect them at any time.
Availability
We work hard to keep the Service available and reliable, but we don’t guarantee it will be uninterrupted or error-free. We may carry out maintenance, and may update or change features over time. We’ll give reasonable notice of material changes where we can.
Warranties and liability
The Service is provided “as is”. To the extent permitted by law, we exclude implied warranties. Nothing in these terms limits rights you have under the Australian Consumer Law that can’t be excluded. Where our liability can be limited, it is limited to re-supplying the Service or refunding the fees you paid for it in the 12 months before the claim. We aren’t liable for indirect or consequential loss, or for loss of data or profits, to the extent the law allows.
Suspension and termination
You can stop using the Service and cancel at any time. We may suspend or end your access if you breach these terms, don’t pay, or use the Service in a way that risks harm — we’ll give notice where reasonable. On termination, your data is handled as set out above and in the Privacy policy.
Changes to these terms
We may update these terms from time to time. We’ll change the date at the top and, for significant changes, notify you in the app or by email. Continuing to use the Service after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of Australia, and you and HappierBiz submit to the non-exclusive jurisdiction of the Australian courts.
